1 Ⅱ 貿易管理について (1) 輸入通関に係る留意についてタイ向け輸出の際の現地輸入通関手続きおよび留意点についてタイでの輸入通関時にしばしば直面する問題は高い輸入関税と通関に時間がかかる場合があるということであるこれらの問題に対処するために留意すべき点は以下の通りである 1. 輸入関税率輸入申告時に品目毎に適用される関税率が決定されるがどの HS コード ( 関税分類番号 ) にあてはまるのかが問題で不明確な商品名の場合は厳しく税関で判断され高い方の税番税率が適用される場合があるこれを防止し適切な HS コードの適用を受ける為には輸入申告におけるインボイスの記載で適切で明確な品目名とし当該商品機械の説明書仕様書写真等を予め準備し審査官に説明し納得を得ることであるまたタイでは輸入申告書に添付されているインボイス上の価格が必ずしも関税の算定基準になるとは限らず審査官は他社扱いインボイスを含めて過去の実績の中から同品目で高い方の単価を基準にして輸入関税を決定することがあるので注意が必要であるインボイス価格の妥当性を示す為にプライスリストやインボイスに日本の商工会議所の認証を受けるのも一助である 2. 通関に掛かる時間の短縮 2004 年 12 月より輸入手続きのスピードアップ化が図られ輸入申告から 1 日から 2 日程度で貨物の引取りができるようになっているしかしインボイスに記載されている品目が多く申告項目が多い場合は更に日数がかかるこの日数を極力短縮する為に上述の HS 番号決定のための説明資料を多く準備しておく等の配慮が有効である (2) 税率についてタイの関税評価については日本と同様に申告納税制度 ( 評価申告制度 ) であり申告されたインボイスに基づいて CIF 価額関税率または輸入数量従量税 ( 従価税または従量税のいずれか高額の方 ) で関税額が算出されそれらの課税価額 (CIF 価額 + 関税額 ) に付加価値税 (VAT)7% が課される ( 注 : 関税局で確認したところによるとインボイスが CIF ベースでない場合つまり貨物保険が含まれてない場合は保険料をインボイス額の1% として計算している ) 日本に適用される関税率については原則としては WTO 加盟国を対象とした関税率であるがタイ政府は定期的に関税率の見直し ( 削減 ) をおこなっており税率を削減 ( ディスカウント ) した品目については財務省告示で通達しているそのため日本の場合についてもこのディスカウントレートが採用されているそのほか既に発効している日タイ経済連携協定 JTEPA-に係る関税の適用率が採用されているなお関税率については財務省関税局で照会は可能であるが同局のウェブサイトでも関税率データベースを提供しており適用関税率を検索することができる問合せ先財務省関税局 (Customs Department) 関税率分類および政策部 (Customs Tariff Classification and Policy Directorate) The 4 th floor, Building No.8 of Customs Department, Thanon Sunthonkosa, Khlong Toey, Bangkok, Tel 関税局コールセンター :1164( 国内のみ ) 同ウェブサイト内の関税率データベース : 268

2 (3) 農産物輸入制限品目タイは輸出入管理法 (1979 年 ) および関係規則に基づき一部の品目について1 公益上の理由 2 国内産業産品の保護 3 外貨流出防止の3つの理由により輸入を制限しておりこの法律による制限品目および内容は商務省外国貿易局が毎年発表している 2007 年度については輸入禁止品目が 9 品目輸入課徴金品目が 3 品目輸入許可品目 36 品目 WTO 合意に基づく輸入規制 ( 関税割当 ) 品目 22 品目となっておりそのうち農林水産品に関連するものは以下のとおりである ( 商務省外国貿易局による分類に基づく ) i) 輸入禁止品目 - タークにおける国境地帯からのチーク輸入リベリア共和国からの木材およびその製品商標を偽造しあるいは贋造した品目の 3 品目 ii) 輸入課徴金品目輸入の際に課徴金を支払わなければならない農水産品 (3 品目 ) 品目名所轄官庁 1 魚粉 ( タンパク質が 60% 以上のもの ) < > 商務省外国貿易局一般商品輸出入管理部及び外国貿易サービス部 2 飼料用トウモロコシ < > 3 大豆ミール < > 注 :< > 内は HS 分類番号を示す商務省外国貿易局穀物協定商品管理部及び同局外国貿易サービス部 iii) 輸入許可品目 - 輸入の際には所轄官庁からの輸入許可を必要とする農林水産品は以下の 5 品目である品目名 <HS コード > 所轄官庁 1 魚粉 ( タンパク質が 60% 未満のもの ) 商務省外国貿易局 < > 一般商品輸出入管理部及び外国貿易サービス部 2 ジュートおよびケナフ < >,< >,< >,< > 3 麻袋 ( ジュートバッグ ) < >,< > 4 材木加工木材木製工芸品用具およびその他の木製品 <44.03>,<44.07~44.21> 5 キハダマグロ (Yellowfin Tuna) およびその製品 < 記載なし > 注 :< > 内は HS 分類番号を示す農業協同組合省水産局 iv) WTO 合意に基づく輸入規制 ( 関税割当 ) 品目 -WTO 合意によりタイが関税割当を設定している農林水産品目は以下の 22 品目である所轄官庁はすべて商務省外国貿易局穀物協定商品管理部及び同局外国貿易サービス部である 269

4 としている (1) 原産地証明書 (C/O): 日本政府または日本政府の信託を受けたその他の機関から発行された原産地証明書及び (2) 商務省外国貿易局または商務省が定めた機関で発行する関税率の一部またはすべての削減を得る権利を示す証明書 ( 注 : 商務省による貿易管理規制の下ですべての WTO 加盟国に適用されている関税割当などの輸入許可の証明書のことを意味する ) つまり JTEPA による関税率削減の適用を受けるためには原産地証明書と商務省からの関税割当適用の数量申請と輸入許可書を事前に得る必要がありその数量は通常の WTO 加盟国に対する割当数量の制限を受ける 271
