1 まなビューア 使用許諾書 まなビューア ( 以下 本ビューア という ) を使用する際には, 次の ソフトウェアのご使用条件 の全ての条項に同意する必要があります 本ビューアを利用された方は, 下記, ソフトウェアのご使用条件 の各条項に同意したものとみなされます 本 ソフトウェアのご使用条件 をご確認, ご理解頂いた上で本ビューアを使用してください ソフトウェアのご使用条件 1. 使用許諾 (1) 光村図書出版株式会社 ( 以下 当社 といいます ) は, お客様が本文に同意し, これを遵守することを条件として, お客様に対し本ビューアの日本国内における譲渡不能 無償の非独占的使用権を許諾します なお, 次項に示すオープンソースソフトウェアを除き 本ビューアに関する一切の知的財産権および所有権は当社に帰属します (2) 本ビューアは 別表に示すオープンソースソフトウェアを含んでいます 別表記載のオープンソースソフトウェアの使用条件はそれぞれの適用ライセンスに従います 2. 禁止事項 (1) お客様は, 本ビューアの全部若しくは一部を逆アセンブル又は逆コンパイルすることもさせることもできません (2) お客様は, 本ビューアの全部若しくは一部を改変し, 又は他のプログラムと結合することもさせることもできません (3) お客様は, 本ビューアを固定している記録媒体を廃棄する場合には 固定された本ビューアをあらかじめ復元不可能な状態に消去 削除その他の消滅の措置を必ず講ずるものとします 3. 利用者情報の取扱い お客様が本ビューアを使用するに当たり当社が取得する利用者情報はありません 4. 当社の免責 当社は 本ビューアを現状有姿のままお客様に提供するものとし 明示又は黙示を問わず 一切の法律上のいかなる保証も提供しないものとします また 当社は 本ビューアに関し お客様に生じたいかなる損害 損失 請求その他の責任についても一切の責任を負わないものとします なお お客様が本 ソフトウェアのご使用条件 に違反し 当社に損害が生じた場合は お客様は一切の賠償責任を負うものとします 5. 輸出等の処置 お客様が本ビューアの全部若しくは一部を単独で 又は 他の製品と組み合せ 若しくは他の製品の一部として 直接又は間接に輸出すること 国外に持ち出すこと 国内非 1

2 居住者に提供し または 使用させるなどの取扱いをする場合は お客様は 外国為替及び外国貿易法 の規制及び米国輸出管理規則等外国の輸出関連法規を確認の上 必要な手続きをとるものとします 6. 解除 (1) お客様が本 ソフトウェアのご使用条件 に違反した場合, 当社は本 ソフトウェアのご使用条件 に基づく許諾を解除し, お客様の本ビューアの使用を終了させることができます この場合 お客様は 本ビューアを破棄または消去するものとします (2) お客様は 本ビューアを廃棄または消去することにより本 ソフトウェアのご使用条件 を終了させることができるものとします 7. 暴力団等の排除 (1) お客様は 現時点及び将来にわたって 自己が次の各号のいずれにも該当しないことを表明し 又は確約するものとします 1 暴力団 暴力団員 暴力団準構成員 暴力団関係企業 総会屋 社会運動等標ぼうゴロ 特殊知能暴力集団その他これらに準ずる者 ( 以下総称して 反社会的勢力 といいます ) であること 又は反社会的勢力であったこと 2 反社会的勢力が経営を支配していること 3 代表者 責任者又は経営に実質的に関与している者が反社会的勢力であること 4 自己又は第三者の不正の利益を図る目的をもってするなど反社会的勢力を利用していると認められる関係を有すること 5 反社会的勢力に対して資金等を提供し 又は便宜を図るなど反社会的勢力に利益を供与していると認められる関係を有すること 6 反社会的勢力と密接に交際をするなど社会的に非難されるべき関係を有すること 7 暴力的又は法的な責任を超えた不当な要求行為を行うこと 8 取引に関して脅迫的な言動をし 又は暴力を用いる行為を行うこと 9 風説を流布し 又は偽計若しくは威力を用いて 相手方の信用を毀損し 又は相手方の業務を妨害する行為を行うこと (2) お客様が前項の表明又は確約のいずれかに違反した場合 当社は通知その他の手続を要しないで 本 ソフトウェアのご使用条件 に基づく許諾の全部又は一部を解除することができ 解除により生じた損害の賠償をお客様に請求できるものとします また 係る解除によりお客様に生じた損害について 当社は賠償義務を負わないものとします 8. 準拠法及び管轄裁判所 本 ソフトウェアのご使用条件 は日本法に準拠するものとし 本 ソフトウェアのご使用条件 に関する一切の紛争については, 東京地方裁判所のみを管轄裁判所として処理するものとします 以上 光村図書出版株式会社 2
