Security of Leasehold Interest -in cases of the False Housing Registries by Other Than the Lessee by Shin ISHIKAWA The House Protection Act 1909 in Japan, under which many lessees can be protected from eviction by the part of new lessors, entitles a housing registry to the security of Leasehold interest as replacement of a registry of Leasehold interest itself. This Act may be useful in Japanese society, but has many difficult questions because of the unclear provision. It has been argued that a false housing registry, in particular registered by other than a lessee, should have been available as replacement of a registry of Leasehold interest. The Japanese courts have still denyed the security of Leasehold interest in the case of other than the lessee,. Justification, however, should be reviewed from the standpoint of protecting the lessee. In this paper, some of the approaches to solve the questions will be considered, after, some important cases in Japanese Supreme Court are pointed out.
