3 Amended Rule 36 EPC (as of April 1, 2010) 1) The applicant may file a divisional application relating to any pending earlier European patent application, provided that: a) the divisional application is filed before the expiry of a time limit of 24 months from the Examining Division's first communication in respect of the earliest application for which a communication has been issued, or b) the divisional application is filed before the expiry of a time limit of 24 months from a communication in which the Examining Division has objected that the earlier application does not meet the requirements of Article 82, provided it was raising that specific objection for the first time. 19 Amended Rule 137 EPC (as of April 1, 2010) Mandatory provision of the basis for amendments Applicants are now obliged to clearly identify any amendments and to indicate the basis for them in the application as filed. 21 Criterion to determine the admissibility of an amendment (T 288/92) The admissibility of amendments under Art. 123(2) EPC is to be decided solely on the basis of examining whether the amendments are directly and unambiguously derivable (extractable) from the application as filed. 41 補正の許容性を決定する基準 (T 288/92) EPC 第 123 条 (2) に基づく補正の許容性は補正が当初の出願から直接的にまた明らかに直接的にまた明らかに導き出せる ( 抽出可能 ) か否かについてのみに基づいて決定される 42

23 Amended Rule 137 EPC (as of April 1, 2010) Only one opportunity to file voluntary amendments Applicants will be granted only one chance by law to make amendments of their own volition during the European examinations proceedings. 26 New Rule 62a EPC (as of April 1, 2010) Applications containing a plurality of independent claims (1) If the European Patent Office considers that the claims as filed do not comply with Rule 43, paragraph 2, it shall invite the applicant to indicate, within a period of two months, the claims complying with Rule 43, paragraph 2, on the basis of which the search is to be carried out. If the applicant fails to provide such an indication in due time, the search shall be carried out on the basis of the first claim in each category. (2) The Examining Division shall invite the applicant to restrict the claims to the subject-matter searched unless it finds that the objection under paragraph 1 was not justified. 51 新 EPC 第 62a 規則規則 (2010 年 4 月 1 日以降 ) 下記の場合出願は複数の独立クレームを含む (1) 欧州特許庁は当初のクレームが第 43 規則第 2 項に従っていないとみなす場合調査が行われる内容に基づいて 2 ヶ月の期間内に第 43 規則第 2 項に従うクレームを示唆するように出願人に求める出願人が期限内にそのような示唆を提出しない場合は各カテゴリーの最初のクレームに基づいて調査が行われる (2) 審査部は第 1 項に基づく拒絶が正当でなかったと判断しない場合は調査がなされた対象にクレームを限定するように出願人に求める 52

27 Amended Rule 63 EPC (as of April 1, 2010) Incomplete search (1) If the European Patent Office considers that the European patent application fails to such an extent to comply with this Convention that it is impossible to carry out a meaningful search regarding the state of the art on the basis of all or some of the subject-matter claimed, it shall invite the applicant to file, within a period of two months, a statement indicating the subject-matter to be searched. (2) If the statement under paragraph 1 is not filed in due time, or if it is not sufficient to overcome the deficiency noted under paragraph 1, the European Patent Office shall either issue a reasoned declaration stating that the European patent application fails to such an extent to comply with this Convention that it is impossible to carry out a meaningful search regarding the state of the art on the basis of all or some of the subject-matter claimed or, as far as is practicable, draw up a partial search report. The reasoned declaration or the partial search report shall be considered, for the purposes of subsequent proceedings, as the European search report. (3) When a partial search report has been drawn up, the Examining Division shall invite the applicant to restrict the claims to the subject-matter searched unless it finds that the objection under paragraph 1 was not justified. 28 New Rule 70a EPC (as of April 1, 2010) Response to the extended European search report (1) In the opinion accompanying the European search report the European Patent Office shall give the applicant the opportunity to comment on the extended European search report and, where appropriate, invite him to correct any deficiencies noted in the opinion accompanying the European search report and to amend the description, claims and drawings within the period referred to in Rule 70, paragraph 1. (2) In the case referred to in Rule 70, paragraph 2, or if a supplementary European search report is drawn up on a Euro-PCT-application, the European Patent Office shall give the applicant the opportunity to comment on the extended European search report and, where appropriate, invite him to correct any deficiencies noted in the opinion accompanying the European search report and to amend the description, claims and drawings within the period specified for indicating whether he wishes to proceed further with the application. (3) If the applicant neither complies with nor comments on an invitation in accordance with paragraph 1 or 2, the application shall be deemed to be withdrawn. 55 新 EPC 第 70a 規則規則 (2010 年 4 月 1 日以降 ) 拡張欧州調査報告に対する応答 (1) 欧州調査報告に添付される意見書において欧州特許庁は拡張欧州調査報告に対して意見を述べる機会を出願人に与えそして適切である場合は第 70 規則第 1 項で言及される期間内に欧州調査報告に添付された意見書で述べられた不備を訂正及び明細書クレーム及び図面を補正するように出願人に求める (2) 第 70 規則第 2 項で言及される場合又は Euro-PCT 出願について補充欧州調査報告が作成される場合は欧州特許庁は拡張欧州調査報告に対して意見を述べる機会を出願人に与えそして適切である場合は出願のさらなる手続きを希望するか否かを示すための期間内に欧州調査報告に添付された意見書で述べられた不備を訂正及び明細書クレームおよび図面を補正するように出願人に求める (3) 出願人が第 1 又は 2 項に基づく要請に従わない又は意見を述べない場合は出願は取り下げられたものとみなされる 56

29 Amended Rule 161 EPC (as of April 1, 2010) Amendment of the application (1) If the European Patent Office has acted as the International Searching Authority and, where a demand under Article 31 PCT was filed, also as the International Preliminary Examining Authority for a Euro-PCT application, it shall give the applicant the opportunity to comment on the written opinion of the International Searching Authority or the International Preliminary Examination Report and, where appropriate, invite him to correct any deficiencies noted in the written opinion or in the International Preliminary Examination Report and to amend the description, claims and drawings within a period of one month from the respective communication. If the applicant does not comply with or comment on an invitation in accordance with the first sentence, the application shall be deemed to be withdrawn. (2) Where the European Patent Office draws up a supplementary European search report on a Euro-PCT application, the application may be amended once within a period of one month from a communication informing the applicant accordingly. 30 Amended Rule 137 EPC (as of April 1, 2010) Amendment of the European patent application (1) Before receiving the European search report, the applicant may not amend the description, claims or drawings of a European patent application unless otherwise provided. (2) Together with any comments, corrections or amendments made in response to communications by the European Patent Office under Rule 70a, paragraph 1 or 2, or Rule 161, paragraph 1, the applicant may amend the description, claims and drawings of his own volition. (3) No further amendment may be made without the consent of the Examining Division. (4) When filing any amendments referred to in paragraphs 1 to 3, the applicant shall identify them and indicate the basis for them in the application as filed. If the Examining Division notes a failure to meet either requirement, it may request the correction of this deficiency within a period of one month. (5) Amended claims may not relate to unsearched subject-matter which does not combine with the originally claimed invention or group of inventions to form a single general inventive concept. Nor may they relate to subject-matter not searched in accordance with Rule 62a or Rule 改正 EPC 第 137 規則規則 (2010 年 4 月 1 日以降 ) 欧州特許出願の補正 (1) 欧州調査報告を受け取る前に出願人は別段の定めがある場合を除き欧州特許出願の明細書クレーム又は図面を補正することができない (2) 第 70a 規則第 1 又は 2 項又は第 161 規則第 2 項に基づく欧州特許庁からの通達に対してなされた意見訂正又は補正と共に出願人は自発的に明細書クレーム及び図面を補正することができる (3) 審査部の同意無しにさらなる補正をすることはできない (4) 第 1 乃至 3 項で言及された補正を提出する際に出願人はその補正を特定しかつ当初の出願におけるその根拠を示すどちらか一方の要件が満たされていないと指摘する場合は審査部は 1 ヶ月の期間内にこの不備を訂正するように求めることができる (5) 補正されたクレームは, 当初にクレームされていた発明又は単一の包括的発明概念を形成している一群の発明と関連していない未調査の対象に関するものであってはならない又は第 62a 又は 63 規則に基づいて調査されなかった対象に関するものであってはならない 60
