18 Department of Police Administration at Kyungwoon University Abstract It is not easy to organize the term refugee as generally used concept. From seen as a general meaning, refugee is a person who left his own residential place to seek a place where he can enjoy freedom or safety because his own residential place has bad condition or situation so that he cannot live longer there. But definition of refugee is many and has not been fixed even in international law. That is, the term refugee is very abstract and obscure so that the concept can be changed enough according to era or a subject to apply it. Such abstraction and ambiguity of the term refugee made its definition be difficult. Nonetheless, international society has continued to establish its concept and protect them. The reason is that to define concept of refugee is important from the viewpoints of not only international protection of human right but also providing standard in juridical judgement about refugee. But Korea experienced a transition period for several years and actively recognized position as a refugee from 2001. And although recently applicants for refugee are on the sharp rise and some related cases including Korean Supreme Court precedents appeared, active study on subtle definition of refugee is still poor in Korea. Accordingly, this study tried to more clearly define concept of refugee by reviewing and analyzing refugee definitions shown on refugee treaties adopted before the World War II when international protection for refugees began, refugee treaties concluded after the World War II, and finally, Korean refugee law that introduced refugee definition in 1951 Convention relating to the Status of Refugees as it is through various materials and academic demonstration methods of domestic and foreign countries.
