EU-ICS( 輸入 24 時間ルール ) The ICS : ICS ( 輸入コントロールシステム ) とは Is focused on the implementation of the implementing provisions of the security amendment 1875/2006 セキュリティ法改正 1875/2006 に基づく同規則導入に照準 The main process is the pre-arrival filing of the ENS for all European Union (EU) bound shipments on the means of transport (including FROB) EU 域内向け輸送貨物 ( 通過貨物含む ) に関する ENS( 輸入総括申告 ) の事前ファイリングが主な処理対象 The ENS must be filed to the first office (country) of entry in EU ENS は EU 域内の最初の税関管署 ( 国 ) へのファイリング This implies possible different data formats & communication protocols for every EU country つまり EU 域内の国により異なるデータフォーマット 通信方法の採用を意味する 20
ICS-ENS 義務と課題 2. EU-ICS( 輸入 24 時間ルール ) A risk assessment is applied on the ENS data in the office of first entry and the risk results (type C) are communicated to the subsequent EU offices 域内最初の税関管署は ENS データに対してリスク評価を行い 評価結果 (type C) は後継各国に伝達される Different time limits are in place by mode of transport and type of cargo: 輸送モード及び貨物の種類により異なる時間的制限 Deep sea container transport: 24 hours before loading at the port of departure Bulk/break bulk: 4 hours before arrival at the first EU port Short sea transport: 2 hours before arrival at the first EU port Short haul flights: at least by the time of the actual take off of the aircraft Long haul flights: at least 4 hours before arrival at the first EU airport Road traffic: 1 hour before arrival at the first EU Customs office Inland waterways & rail: 2 hours before arrival at the first EU Customs office ( 参考 ) リスク評価 (Security Risk Assessment) ENS を受理する EU 域内で寄港する最初の国 ( 港 ) の税関はセキュリティリスクの評価を行い 仮にリスクがあると判断した場合には 危険度に従って以下の対処方法を決め 船積み港及び後続の寄港地へ通達する Risk Type A = do not load 送信 Risk Type B = 最初の入港港湾での差し止め 検査 Risk Type C = 荷降ろし予定港湾での差し止め 検査 21
ICS-ENS 義務と課題 2. EU-ICS( 輸入 24 時間ルール ) The carrier is responsible for filing the ENS, but a third party (e.g. freight forwarder) can also file the ENS ( self-filer ), but only with the consent of the carrier (no double filing) ENS のファイリング主体は船社ですが 第三者 ( フレイトフォワーダー ) も ENS( 自社ファイリング ) が可能 但し 船社による事前承認が条件 ( 重複はなし ) General consensus to have 1 ENS per transport document (House Bill of Lading, airway bill, ) 輸送契約書 (House B/L, airway bill 等 ) 毎に 1 つの ENS が原則 Every valid ENS receives an Movement Reference Number (MRN) 正しい ENS 毎に移動登録番号 (MRN) を付与 Contingency (business continuity): Before arrival: keep on trying On arrival or after arrival: alternative filing or paper 緊急対応 ( ビジネスの連続性 ) 到着前 : 最後まで試行すること 到着時又は到着後 : 代替策又は書類による提出 22
